TERMS & CONDITIONS

1. INTRODUCTORY PROVISIONS

These Terms and Conditions (hereinafter referred to as the “Terms”) govern the rights and obligations between

(hereinafter referred to as the “Seller”)

and the customer – a natural or legal person (hereinafter referred to as the “Buyer”) when purchasing goods via the online store operated at www.spboarding.com (hereinafter referred to as the “E-shop”).

2. APPLICATION OF LEGAL REGULATIONS

These Terms are drawn up in accordance with the legal system of the Czech Republic and the legislation of the European Union, in particular:

Act No. 89/2012 Coll., the Civil Code,
Act No. 634/1992 Coll., on Consumer Protection,
Regulation (EU) 2016/679 (GDPR).

The Seller delivers goods both within and outside the European Union.
For deliveries outside the EU, the Buyer is responsible for any customs duties, taxes, or other charges related to the import of goods into the respective country.

The contractual relationship is governed by the laws of the Czech Republic.
In the case of consumers from other EU countries, this does not affect their rights under the laws of their country of residence.

3. CONCLUSION OF THE CONTRACT

The presentation of goods on the E-shop is for informational purposes only and does not constitute an offer to enter into a contract.

The purchase contract is concluded when the Buyer submits an order and the Seller confirms it via e-mail.

By submitting the order, the Buyer confirms that they have read and agree to these Terms.

4. PRICES AND PAYMENT TERMS

All prices listed on the website are final, including VAT and all related fees (excluding possible customs duties or import taxes outside the EU).

The purchase price may be paid online by credit card via the secure Comgate payment gateway. The price confirmed at the time of order confirmation is final and will not be changed.

5. DELIVERY OF GOODS

The Seller will ensure delivery of goods to the address provided by the Buyer.

Delivery time depends on product availability and the selected shipping method.

Goods made to order will be dispatched no later than 14 days from the conclusion of the purchase contract.

If the order cannot be fulfilled, the Seller will promptly inform the Buyer and offer an alternative solution or a refund.

6. WITHDRAWAL FROM THE CONTRACT (RETURN OF GOODS)

The Buyer – consumer – has the right to withdraw from the contract without giving any reason within 14 days of receiving the goods.

Withdrawal may be made by e-mail or in writing, sent to the Seller’s address.

The Buyer shall return the goods to the Seller at their own expense within 14 days of withdrawal.

The Seller will refund all payments received, including shipping costs, no later than 14 days after receiving notice of withdrawal, using the same payment method unless otherwise agreed.

Goods made to order according to the Buyer’s specifications or wishes (e.g. via an online configurator) cannot be returned or withdrawn from without reason, as such goods are customized under Section 1837(d) of the Czech Civil Code.

If such customized goods are defective, the Buyer retains full warranty and complaint rights as per Article 7 of these Terms.

7. COMPLAINTS AND WARRANTY

The Seller is liable for defects that the goods have upon receipt and for defects arising during the 24-month warranty period.

The Buyer must report a defect without undue delay after discovering it.

Complaints can be submitted via e-mail or in writing, ideally with proof of purchase and a description of the defect.

The Seller will process the complaint within 30 days of its receipt.

8. PERSONAL DATA PROTECTION

The Seller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll.

The data controller is Santaruis s.r.o.

Personal data (name, address, e-mail, phone number) are processed solely for the purpose of:

order fulfillment,
compliance with legal obligations (e.g., accounting),
communication with the customer.Data are stored only for the time necessary to fulfill contractual and legal obligations.
The Buyer has the right to access, rectify, erase, restrict processing, data portability, and object to processing.
Payment data are processed exclusively by the Comgate payment gateway – the Seller has no access to them.

9. OUT-OF-COURT DISPUTE RESOLUTION

The consumer has the right to contact the Czech Trade Inspection Authority (www.coi.cz), which provides out-of-court consumer dispute resolution.

Supervision of personal data protection is performed by the Office for Personal Data Protection (www.uoou.cz).

10. FINAL PROVISIONS

These Terms are governed by the laws of the Czech Republic.

All disputes shall be resolved by the competent courts of the Czech Republic.

The Seller reserves the right to amend these Terms; the current version is always published on the E-shop website.
